Understanding Your Rental Agreement: Key Terms and Responsibilities
A well-structured rental agreement (کرایہ نامہ Rent Lease Deed in Urdu) is essential to establish a clear understanding between the landlord and tenant, ensuring a smooth and hassle-free tenancy. Below are the key terms and responsibilities outlined in a standard Rent lease agreement to protect both parties’ rights and interests.
1. Payment of Rent and Receipts
The tenant (First Party) is required to pay the monthly rent in advance. The landlord (Second Party) must provide a receipt upon receiving the payment to maintain transparency and avoid future disputes.
2. Registration of the Rental Agreement
The responsibility of registering the rent agreement with the Rent Controller falls on the tenant. All registration expenses must also be covered by the tenant to ensure legal compliance.
3. Restrictions on Subletting
The tenant is strictly prohibited from subletting the rented property or any portion of it to a third party under any circumstances.
4. Utility Bills and Property Tax
The tenant is responsible for paying all utility bills, including electricity, gas, and water supply. However, the landlord remains responsible for the payment of property tax.
5. Renovation and Decoration
The tenant is allowed to paint or decorate the property at their own expense, with the condition that no installed decorations or paint should be removed or damaged when vacating the premises.
6. Structural Changes and Usage
No structural modifications can be made by the tenant, and the property must only be used for the agreed-upon purpose as per the rent lease agreement.
7. Maintenance and Repairs
The tenant is responsible for repairing any damages to the property, including electrical wiring and water motors, and must take preventive measures to avoid damage from water, rain, or other elements. Any issues should be reported to the landlord promptly.
8. Neighborhood Conduct
The tenant, their family, or employees must not engage in disputes with neighbors or cause any disturbances.
9. Annual Rent Increase
Upon the expiration of the rental term, the rent will be subject to an annual increase of a predetermined percentage. A new rent agreement must be drafted upon expiry.
10. Notice Period for Vacating
Either party must provide a two-month notice before vacating the property. If the landlord requests the tenant to vacate, the tenant must comply. Similarly, the tenant must notify the landlord if they wish to leave before the lease term ends.
11. Property Inspections
The landlord has the right to inspect the property at any time. Additionally, once a notice to vacate has been issued, the tenant must allow potential new tenants to inspect the premises.
12. End of Rental Term
At the end of the rental period, the tenant must vacate the property without requiring further notice from the landlord.
13. Eviction for Breach of Agreement
If the tenant violates any terms or fails to pay rent on time, the landlord has the right to evict them. The tenant will bear all legal expenses incurred due to eviction proceedings.
14. Refund of Advance Payment
Upon vacating, the landlord must refund any advance payment to the tenant, provided the property is returned in good condition.
15. Legal Framework
Any conditions not explicitly mentioned in the agreement will be governed by the Punjab Rental Act, 2012, ensuring that both parties adhere to the legal framework.
