Punjab Protection of Ownership of Immovable Property Act 2025

During the proceedings, the Tribunal may grant interim relief, regulate possession, and issue directions to the police or other government authorities to protect the property. Upon conclusion of the proceedings, the Tribunal may order the restoration of possession to the lawful owner and direct government agencies to enforce its judgment.

پنجاب تحفظ ملکیت غیر منقولہ جائیداد ایکٹ 2025 (Punjab Protection of Ownership of Immovable Property Act, 2025) حکومت پنجاب کی جانب سے نافذ کیا گیا ایک اہم قانون ہے جس کا مقصد ناجائز قبضہ، قبضہ مافیا، جائیداد فراڈ، اور غیر قانونی قبضہ کے خلاف قانونی مالکان کو مؤثر تحفظ فراہم کرنا ہے۔ اس قانون کے تحت پنجاب پراپرٹی ٹریبونل قائم کیا گیا ہے تاکہ پراپرٹی تنازعات اور زمین پر ناجائز قبضہ کے مقدمات کا جلد اور مؤثر فیصلہ کیا جا سکے۔ یہ قانون پورے پنجاب میں نافذ العمل ہے اور غیر منقولہ جائیداد کے مالکان کے حقوق کے تحفظ کو یقینی بناتا ہے۔

اس قانون کے مطابق اگر کوئی شخص دھوکہ دہی، جعلسازی، جھوٹی نمائندگی، دھمکی، جبر، طاقت یا کسی بھی دوسرے غیر قانونی طریقے سے کسی غیر منقولہ جائیداد پر قبضہ حاصل کرتا ہے یا قبضہ برقرار رکھتا ہے تو اسے ناجائز قبضہ کا مرتکب تصور کیا جائے گا۔ ایسے جرم پر پانچ سے دس سال تک قید، دس ملین روپے تک جرمانہ یا دونوں سزائیں دی جا سکتی ہیں۔ اس کے علاوہ جرم میں معاونت، سہولت فراہم کرنے یا سازش کرنے والے افراد کو بھی سزا دی جا سکتی ہے۔

اگر کسی شخص کی زمین، مکان، دکان یا دیگر جائیداد پر غیر قانونی قبضہ ہو جائے تو وہ پنجاب پراپرٹی ٹریبونل میں پراپرٹی شکایت دائر کر سکتا ہے۔ درخواست کے ساتھ جائیداد کی مکمل تفصیلات، ملکیت کے ثبوت، وقوعہ کی تفصیل اور اگر ممکن ہو تو ملزم کی معلومات فراہم کرنا ضروری ہے۔ شکایت موصول ہونے کے بعد ٹریبونل معاملہ اسکروٹنی کمیٹی کو بھیجتا ہے، جو ریکارڈ کی جانچ، متعلقہ فریقین کی سماعت اور تحقیقات کے بعد اپنی رپورٹ ٹریبونل کو پیش کرتی ہے۔

پنجاب پراپرٹی ٹریبونل کو اس قانون کے تحت خصوصی اختیارات حاصل ہیں۔ ٹریبونل نہ صرف پراپرٹی تنازع اور ملکیت کے حقوق کا فیصلہ کر سکتا ہے بلکہ مقدمے کے دوران عبوری احکامات بھی جاری کر سکتا ہے تاکہ مزید ناجائز قبضہ یا جائیداد کو نقصان پہنچانے سے روکا جا سکے۔ مقدمہ مکمل ہونے پر اگر اصل مالک کا حق ثابت ہو جائے تو ٹریبونل جائیداد کی واگزاری کا حکم دیتا ہے اور پولیس یا دیگر سرکاری اداروں کو اس فیصلے پر عمل درآمد کا پابند بنا سکتا ہے۔
