Direct Filing in Civil Court (سول کورٹ میں براہ راست رسائی)
A major update via the 2025 Amendment has changed how legal heirs approach the system. Previously, Section 10 of the Act forced applicants to visit NADRA first. However, this section has been omitted.
Concurrent Jurisdiction: You can now choose to file your application directly in a Civil Court or with the Authority (NADRA).
No Decline Required: You no longer need a “Decline Certificate” from NADRA to prove you have the right to go to court.
Choice of Forum: If you prefer a judicial order over an administrative certificate, you can initiate the process under the Succession Act 1925 immediately.
When Should You Choose the Civil Court?
While the Succession Facilitation Units at NADRA are efficient , a direct application to the Civil Court is essential in specific scenarios termed as “factual controversies”:
Minor Heirs: If any of the legal heirs is a minor, the court must adjudicate to protect their financial interests.
Identity Disputes: If there is a disagreement regarding who the true legal heirs are.
Property Discrepancies: When the nature or valuation of the property is contested by claimants.
The NADRA Process (نادرا کا طریقہ کار)
For undisputed cases, NADRA maintains a Succession Facilitation Unit. The process involves:
Publication: A notice is published in one English and one Urdu newspaper to alert the general public.
Wait Period: There is a mandatory 14-day period for any objections to be filed.
Biometric Verification: All legal heirs must provide biometrics at any notified NADRA office in Pakistan or abroad.

A complete List of Legal Heirs with valid CNIC copies.
