The Punjab Enforcement and Regulation Act 2024 (PERA) represents a significant legislative initiative by the Punjab government to enhance the enforcement of special laws across the province. Enacted on October 17, 2024, the Act aims to establish a comprehensive framework for regulatory compliance, addressing issues such as inflation, hoarding, and encroachments.

Establishment of the Punjab Enforcement and Regulatory Authority

Central to PERA is the creation of the Punjab Enforcement and Regulatory Authority, a body corporate endowed with perpetual succession and a common seal. This Authority is empowered to enter into contracts, acquire or dispose of property, and initiate legal proceedings under its name. Headquartered in Lahore, the Authority is structured to operate at multiple administrative levels, including provincial, divisional, district, and tehsil tiers, ensuring a broad reach across Punjab.

Composition and Governance

The Authority is composed of a diverse group of members, blending government officials with independent representatives. The Chief Minister of Punjab serves as the Chairperson, with the Chief Secretary acting as the Vice Chairperson. Other members include senior officials from various provincial departments, nominated members of the Provincial Assembly, and independent members selected through a defined process. This composition is designed to balance administrative oversight with independent perspectives.

Enforcement Mechanisms

To operationalize its mandate, PERA introduces the concept of “Enforcement Stations” at the sub-divisional level, distinct from traditional police stations. These stations are staffed by Sub-Divisional Enforcement Officers, Enforcement Officers, Investigation Officers, and supporting personnel. The Act grants these officers powers to conduct inspections, searches, seizures, and arrests related to violations of specified laws. Notably, they are authorized to collect evidence through electronic means, including audio-video recordings and digital forensics, enhancing the efficacy of enforcement actions.

Addressing Inflation and Encroachments

A primary objective of PERA is to combat artificial inflation and hoarding. The Authority is tasked with enforcing laws such as The Punjab Prevention of Hoarding Act 2020 and The Punjab Price Control of Essential Commodities Act 2024. By establishing enforcement bodies at various administrative levels, the Act aims to monitor and regulate market practices effectively. Additionally, PERA addresses the issue of encroachments, empowering officers to remove illegal structures and ensure public spaces are utilized appropriately.

Implementation and Oversight

The Act outlines a structured approach to implementation, with the Authority empowered to delegate functions, establish committees, and frame regulations to achieve its objectives. It also mandates the creation of District Enforcement and Regulatory Boards, chaired by Deputy Commissioners, to oversee enforcement activities at the district level. This multi-tiered structure is designed to ensure comprehensive oversight and accountability in enforcing special laws across Punjab.
